Schedule of fees for the service of the Municipal Archive of the city of Dessau-Roßlau

The city council of the city of Dessau-Roßlau made a joint decision in its meeting on 20th March 2013 concerning the following statutory fees for the service of the Municipal Archive of the city of Dessau-Roßlau based on §§ 2 Abs. 1, 4, 6, 8 and 44 Abs. 3 No. 1 of the Gemeindeordnung (municipal code) of the federal state Saxony-Anhalt (GO LSA) in the version of its promulgation on 10th August 2009 (GVBl. LSA 2009, pp. 383), which was last amended by law on 30th November 2011 (GVBl. LSA 2011, p. 814), as well as §§ 1, 2 and 5 of the Kommunalabgabengesetzes (communal fees regulations) of the federal state Saxony-Anhalt (KAG-LSA) on 13th December 1996 (GVBl. LSA 1996, pp. 405), which was last amended by Artikel 2 of the law on 2nd February 2011 (GVBl. LSA 2011, p. 58):

§ 1
Liability of fees and expenses payable when due

  1. The Municipal Archive of Dessau-Roßlau is raising fees for its service as explicated in § 2 register of fees.
  2. Every person using or requesting the service of the Municipal Archive is obliged to pay fees.
  3. In addition to these fees, the archive’s expenditures have to be paid by the user if they incur as a consequence of using the archive or its services.
  4. The liability to pay fees concerns the performance of official acts or services by the archive as stated in the register of fees. In general, fees are collected immediately after the archive provided official acts and services or within 4 weeks at the latest when the notification of statutory fees imposes the fees that become due for payment.
  5. Users can obtain information upon request about the estimated expenses (fees and expenditures) prior to any service being performed.
  6. Liability to pay fees will be imposed even if the ordered service was never claimed by the user or the research did not deliver expected results.
  7. The Municipal Archive can claim an appropriate advance on fees und expenditures before any service takes place. Records and other archival material may be retained until the fees are paid.

§ 2
Register of fees

The following fees are raised:

1. Written expert reply to a request, commission an expert opinion, research, processing enquiries, data anonymization as required by the law, transcriptions, administrative efforts, commissioned archiving service (conclusion of contracts, preparing records, cassations), presentation or postage of archival material by an archivist will be charged according to expenditure of time

per quarter of an hour EUR 11

2\. Direct service 2.1. Inspection into finding aids, (digital and/or analogue) archival material and repository objects, including simple consultation

2.2. General fee for the provision of archival material from the repository

3. Reproductions

3.1. Reproductions by the user

4. Release of reproductions

Reproduction of any kind in:

4.1 Print, audio visual and electronic mass storage, film and television productions as well as radio broadcasts and their utilisation online, for exhibitions, presentations or advertisements

4.2 Reissues, reprints, translations, licenced editions, repeated broadcasts and utilisation online

5. Guided tours / events

for every half an hour completed or commenced EUR 25

6. Hall rental fees (including preparation time)

§ 3
Reimbursement of expenses

  1. Archive expenditure must be reimbursed by the user if it is the result of any preparations or arrangements of public services or official acts. In particular, expenditure is raised for postage and expenses concerning the delivery (e.g. paper, postage, packaging or insurance).

  2. Furthermore, expenses charged by an external service provider for an order of a user are regarded as expenditure.

§ 4
Remission of fees

  1. Remission or reduction of fees are decided on a case-by-case basis if the merits of the research results are of special interest to the city of Dessau-Roßlau and in concordance with the function and goals of the Municipal Archive. This is especially the case for fees according to § 2 No. 4 for of any kind of reproduction in or for the region Dessau-Roßlau.
  2. The fees stated in § 2 No. 1 and No. 2 are remitted:
    1. if a response to a request is provided either orally or in written form without requiring finding aids or archival materials,
    2. if the goal is not for profit but proves to be beneficial for academic, local historical, or instructional purposes,
    3. if the request and research serve the purpose to deliver evidence for compensation and restitution (e. g. to victims, post-institutionalised children, pensioners).
  3. The fees as referred to in § 2 No. 1 and No. 2 are remitted if there is proof for academic or instructional merits in absence of a commercial purpose. The procedure of furnishing proof for academic merits requires substantiation by written application. Moreover, the condition of an instructional and academic purpose is met if it serves the purpose for research and teaching at universities as well as preparation for lessons und advanced training for teachers. In this case, the procedure of furnishing proof does not require a written application. Fees according to § 2 No. 3 are reduced by 50 % if there is a verifiable academic and instructional purpose for students and pupils.
  4. The remission of fees does not acquit from the obligation to reimburse expenditures when due.

§ 5
Commencement

The schedule of fees is coming into force one day after its public notice. Dessau-Roßlau, 9th April 20131
